Enigmates Application is a purpose-built, multi-faceted platform with the following distinct functionalities:

• Dating: Offers two option to cater to diverse preferences:
  • Angel Mode: Designed for individuals seeking romantic, committed relationships, fostering meaningful, long-term connections based on mutual consent.
  • Demon Mode: Tailored for casual, non-committed relationships, emphasizing flexibility and enjoyment, based on mutual consent.
  • These models allow users to align their experience with personal goals.
• Entertainment Page: A space for sharing uplifting, inspiring, and creative content to foster a positive community, subject to content guidelines.
• Scope of Services: These Terms govern all Enigmates services globally, accessible via any platform interface, and may be updated to incorporate new features or legal obligations.

2.Accessibility and Honesty Policy

The Enigmates platform is accessible to anyone meeting age and legal requirements who chooses to use it. We encourage honesty and transparency about yourself to ensure trustworthy engagement. Verification: We may implement optional identity or age verification using third-party tools to enhance safety and compliance with local laws. Users must cooperate with such requests.

Language Support: The platform offers [list supported languages, e.g., English, Spanish, French] to improve accessibility, with plans to expand based on user demand.

3.Inclusivity Policies

• Inclusivity for the LGBTQ+ Community: Enigmates welcomes the LGBTQ+ community, fostering a safe, open space regardless of sexual orientation or gender identity. Users are encouraged to be honest about their preferences, promoting acceptance and meaningful connections.
• Inclusivity for Disabled Users: Enigmates is committed to accessibility, adhering to WCAG 2.1 Level AA standards. Users may share disability-related information if desired, fostering understanding. We encourage kindness and empathy in all interactions.
• Zero Tolerance Policy: Disrespect, harassment, or exploitation of disabled users (e.g., offensive language, discrimination) results in immediate, permanent removal. Users agree to uphold respect.

4. Terms and Conditions by Mode

• Demon Mode Terms:
  1. Respect and Consent: Mutual respect and consent are required; harassment or coercion is prohibited.
  2. Honesty: Users must disclose intentions and boundaries.
  3. Non-Commitment: For casual connections only.
  4. No Exploitation: Misconduct leads to suspension.
  5. Safe Environment: Users must maintain a drama-free space.
• Angel Mode Terms:
  1. Genuine Intentions: Sincere commitment is required.
  2. Respect and Honesty: Open communication is essential.
  3. Commitment-Oriented: For monogamous, long-term relationships.
  4. Future Goals: Discussions about marriage or family are encouraged.
  5. No Misuse: Exploitation results in removal.
• Entertainment Page Terms:
  1. Positive Content: Posts must uplift and inspire.
  2. Prohibited Content: Includes sexual, hateful, violent, political, or financial material.
  3. Respect: Harassment or trolling is banned.
  4. Originality: Copyright violations are prohibited.
  5. Enforcement: Violations result in content removal or suspension.

5.Acceptance of Terms

By accessing or using Enigmates, you agree to comply with these Terms and applicable laws.  Consent: Your continued use after updates (notified at least 14 days in advance where required by law) constitutes acceptance. Minors (under 18 or the age of majority) are prohibited from using the platform.

6. Types of Content

• Your Content: Content you upload.
• Member Content: Content provided by other users.
• Our Content: Content owned or licensed by Enigmates.

7. Content Guidelines

• Prohibited Content: Includes illegal, harmful, defamatory, infringing, obscene, or spammy material. See Community Guidelines (updatable) for details.
• Your Content: Must comply with Guidelines. You are responsible and agree to indemnify us against claims. Rules:
  1. No personal or financial information in profiles.
  2. Sharing data is at your risk.
  3. Content is globally visible.
  4. By uploading, you grant Limited License: Non-exclusive, royalty-free, worldwide license to use, display, and store Your Content for App operation, revocable upon deletion (subject to backups for 30 days). User Rights: You may request content removal via [email protected].
• Member Content: Belongs to its uploader. Use only for intended purposes; misuse leads to termination.
• Our Content: Owned by Enigmates. Limited, revocable license for App use; no modification or commercial use allowed.

8. Content Monitoring

We may review and remove content for safety, without pre-screening obligation. Transparency: Removal decisions are logged, with appeal options (see Section 18).

9. Recommender Systems

Matching algorithms predict compatibility. See Privacy Policy for details. 

10. Global Availability

Services are worldwide. Users must comply with local laws. Cross-Border Data: Data transfers comply with GDPR, CCPA, LGPD, PIPL, and other laws, using safeguards (e.g., Standard Contractual Clauses, BCRs).

11. Eligibility

• Age Restrictions: Users must be 18 or the age of majority in their jurisdiction. Verification: We may use third-party tools to verify age; misrepresentation leads to termination.
• Legal Compliance: No convictions endangering others or legal prohibitions.
• Account Review: We may reject or terminate non-compliant accounts.

12. Account Responsibilities

• Creation: Provide accurate information. Use manual registration or Google/Apple login; data use per Privacy Policy.
• Security: Protect login details; report breaches to [email protected].
• Termination: We may suspend for violations; users may delete accounts via app (content removal may take 30 days).
• Usage: No sharing or using others’ accounts.

13. User Conduct

Prohibited: Harassment, fraud, illegal activities, or disruptive behaviour. Paid engagements must comply with laws; illegal solicitation (e.g., escorting) is banned.

14. Safety Guidelines

We cannot guarantee safety. Users must:

• Meet in public spaces.
• Inform others of plans.
• Report misconduct via app or [email protected]. Safety Tools: Includes in-app reporting, [emergency contact feature]. Background Checks: Optional verification may be offered in select regions.

15. Liability Disclaimer

Enigmates facilitates interactions but does not verify profiles. No guarantees on outcomes. Limitation: Liability is limited to the maximum extent permitted by law, excluding gross negligence or willful misconduct. Mandatory Rights: Nothing limits rights under consumer laws (e.g., EU Directive 2019/770, Australian Consumer Law).

16. Payments and Subscriptions

• Paid Features: Require payment; agree to displayed terms.
• Processing: Handled by third-party providers securely.
• Refunds: Non-refundable except as required by law (e.g., EU 14-day cooling-off period). Disputes to [email protected] within 30 days; resolved within 10 business days.

17. Privacy Policy

Data collection, storage, and use per Privacy Policy, compliant with GDPR, CCPA, LGPD, etc. Users may request data access, correction, deletion, or portability via [email protected]. Data Breach: Notified within 72 hours as required by law.

18. Dispute Resolution

• Process: Submit disputes in writing to [email protected] within 30 days. If unresolved, arbitration per [e.g., ICC Rules] in Guernsey, unless local law requires otherwise.
• Costs: Users bear fees unless law states otherwise.
• EU/UK Rights: EU users may use out-of-court processes or courts; UK users may claim breach of contract.
• Appeals: Appeal account/content actions within 6 months, with independent review if requested.

19. Governing Law

Governed by UK and Guernsey laws, respecting mandatory local laws. Jurisdiction: Disputes resolved in Guernsey courts or arbitration, unless local law applies.

20. Termination of Services

• App-Initiated: Suspension/termination for violations without notice (except where prohibited).
• User-Initiated: Delete via app; content removal within 30 days.
• Monitoring: Automated systems and moderators enforce Terms; IP blocking may occur.

21. Additional Rights for EU and UK Users

• EU: Digital Services Act rights (e.g., regulatory complaints, content appeals).
• UK: Claim breach of contract for wrongful account/content actions.

22. Unauthorized Access

No tampering with non-public areas. Violations may lead to legal action.

23. Intellectual Property

Ownership: All Enigmates IP (e.g., logos, code) is protected. Users may not reverse-engineer or sublicense.

• DMCA: Report infringements to [email protected]; we issue takedowns on your behalf.

24. Force Majeure

Exemption: We are not liable for delays due to events beyond our control (e.g., natural disasters, cyberattacks).

25. Severability

Validity: If any term is invalid, remaining terms remain enforceable.
