1. THE APPLICATION

Enigment ("Licensed Application") is a software designed to foster social connections through live video and text chat. It is intended for iOS and Android devices. Enigment is not tailored for compliance with industry-specific regulations (e.g. HIPAA, FISMA) and must not be used in contexts where such compliance is required.

2. SCOPE OF LICENCE

• You are granted a non-transferable, non-exclusive, non-sublicensable licence to install and use Enigment on devices owned or controlled by you, as permitted by Usage Rules.
• This licence governs all updates, replacements, or supplements, unless separate terms accompany them.
• You may not share, sell, rent, lease, redistribute, or sublicense the application.
• You may not reverse engineer, decompile, modify, translate, or create derivative works without prior written consent from Delaware Corporation.
• You may not remove intellectual property notices or copy the Licensed Application except as permitted for backups.
• Any violation may result in prosecution and damages.
• Delaware corporation reserves the right to modify these terms at any time.
• You must comply with all applicable third-party terms when using Enigment.

3.TECHNICAL REQUIREMENTS

• Delaware Corporation aims to keep Enigment updated to support new device versions, but does not guarantee continued compatibility.
• You are responsible for ensuring your device meets technical requirements.
• Delaware Corporation may modify technical specifications at any time.

4. MAINTENANCE AND SUPPORT

• Delaware Corporation is solely responsible for providing maintenance and support.
• Services have no obligation to provide maintenance or support for Enigment.

5. USE OF DATA

By using Enigment, you consent to Delaware Corporation accessing and using technical data related to your device, system, and app usage to improve products and services, in compliance with its Privacy Policy.

6. USER-GENERATED CONTRIBUTIONS

Enigment may allow you to post content ("Contributions") visible to others. You represent and warrant that:

• You own or have rights to your Contributions.
• Your Contributions do not infringe intellectual property, privacy, or any applicable laws.
• Contributions are not false, harassing, obscene, hateful, or promoting illegal activities.

Violation may result in suspension or termination of your licence.

7. CONTRIBUTION LICENCE

By posting Contributions, you grant Delaware Corporation a worldwide, irrevocable, perpetual, royalty-free licence to use, reproduce, distribute, and display your Contributions for any purpose. You retain ownership but waive moral rights. Delaware Corporation may edit or remove Contributions at its discretion.

8. ZERO TOLERANCE POLICY

Enigment prohibits:

• Sexually explicit content
• Violent or graphic content
• Hate speech or discrimination
• Harassment or bullying
• Illegal activities

Violations will lead to removal, suspension, or permanent ban, and may be reported to authorities. Users must report violations to maintain community safety.

9. LIABILITY

Delaware Corporation is liable only for intent and gross negligence, except in cases of injury to life, body, or health. Liability for slight negligence applies only to breach of essential obligations and is limited to foreseeable damages.

10. WARRANTY

Delaware Corporation warrants that Enigment is free from malware at download. No warranty applies if the app is modified, misused, or used with incompatible devices. Issues must be reported within 30 days. Remedies include repair or replacement at Delaware Corporation's discretion.

11. PRODUCT CLAIMS

Delaware Corporation, not Services, is responsible for addressing claims related to Enigment, including product liability or regulatory compliance.

12. LEGAL COMPLIANCE

You represent that you are not in a country subject to UK, US, or EU embargo or on any restricted parties list.

14. TERMINATION

This licence remains effective until terminated by Delaware Corporation or you. It terminates automatically if you breach any term. Upon termination, you must cease use and delete all copies of Enigment.

15. THIRD-PARTY TERMS & BENEFICIARY

Delaware Corporation complies with applicable third-party terms. Apple and Google are third-party beneficiaries of this EULA and may enforce it against you.

16. INTELLECTUAL PROPERTY RIGHTS

Delaware Corporation is responsible for investigating and resolving third-party intellectual property infringement claims related to Enigment.

17. APPLICABLE LAW

This EULA is governed by UK law. Courts of England and Wales have exclusive jurisdiction over disputes.

18. MISCELLANEOUS

If any provision is invalid, the remaining provisions remain effective. Changes require a written agreement.
